<p><span style="color: #000000;">Em meio ao impacto do estranho comportamento de Donald Trump, que procura governar usando marketing em dosagem paquidérmica, tentando desconhecer até mesmo a Constituição americana, a mais famosa do mundo, e nessa bagunça um dos lugares comuns da atualidade é culpar as redes sociais pela deterioração que vivemos.</span></p>
<p><span style="color: #000000;">Essa tendência é mundial. De repente, as redes sociais passaram a ser acusadas de crimes gravíssimos. É preciso regulamentá-las, o mais rápido possível, antes de que destruam a sociedade atual e o que resta de conservacionismo, e tudo isso em plena era do LGBTQIAPN+, uma sigla que não para de crescer, porque é impossível conter as preferências humanas.</span></p>
<p><span style="color: #000000;"><strong>NINGUÉM SABE</strong> – A única coisa certa a respeito das redes sociais é que ninguém sabe como regulamentá-las, um desafio jurídico que paira sobre a humanidade como uma esfinge flutuante nas nuvens da cibernética.</span></p>
<p><span style="color: #000000;">Virou conceito (ou pré-conceito) dizer que a União Europeia já teria elucidado a questão, através da Lei dos Serviços Digitais, chamada de DAS, que estabelece regras para o funcionamento de plataformas digitais e entrou em vigor em 17 de fevereiro de 2024.</span></p>
<p><span style="color: #000000;">A DSA se aplica a plataformas de grande dimensão, como o Google, Meta e X (antigo Twitter). Seus objetivos são proteger os consumidores; estabelecer regras de transparência e responsabilidade para as plataformas digitais; combater conteúdos ilegais etc.</span></p>
<p><span style="color: #000000;"><strong>APENAS INTENÇÕES</strong> – Na verdade, a DAS atua no terreno das intenções óbvias, proibindo anúncios direcionados a menores de idade com base em dados pessoais ou confidenciais, exigindo uma moderação de conteúdo mais rígida e a abertura de espaço para os usuários denunciarem serviços ilegais.</span></p>
<p><span style="color: #000000;">Nada de novo no front ocidental, não há – nem poderia haver – nenhuma regulamentação, até porque cada país adota suas próprias leis.</span></p>
<p><span style="color: #000000;">O ponto central dessa discussão que não tem fim é a possibilidade de responsabilizar não somente o usuário delituoso, mas também a própria rede social.</span></p>
<p><span style="color: #000000;"><strong>PONTO POLÊMICO</strong> &#8211; É claro que as redes sociais não querem ser responsabilizadas pelas maluquices dos usuários. Ou seja, se posicionam como os jornais, que jamais se responsabilizaram pelas opiniões dos colunistas e colaboradores.</span></p>
<p><span style="color: #000000;">Além disso, as redes sociais exigem que os prejudicados apresentem queixa e que se abra o devido processo legal, com direito de defesa e de recurso etc. e tal.</span></p>
<p><span style="color: #000000;">O problema em relação ao Brasil é que o ministro Alexandre de Moraes não concorda com isso, está pouco ligando para o devido processo legal e sai atropelando as redes sociais em ações judiciais sigilosas, condenando, multando e bloqueando contas bancárias sem base legal, um verdadeiro festival de ilegalidades puras.</span></p>

P.S.</strong> – <em>No mundo inteiro, ninguém sabe como regulamentar as redes sociais, prevenir fake news e uso político dos perfis, porque é preciso respeitar as mais sagradas regras da democracia – o devido processo legal, a liberdade de expressão, o direito de defesa e de recurso etc. O ministro Alexandre de Moraes também não sabe como regulamentar, mas finge saber. <p>O novo governo dos Estados Unidos, de Donald Trump, poderá impor sanções econômicas ou comerciais a países, como o Brasil, acusados de adotar formas de censura. 			<div class="comment-content"><p>Inicialmente podemos copiar (adaptar) a legislação da UE com a regulamentação das redes sociais que vale para todos os países membros e criar uma lei necessária para regulamentar as redes sociais, criando responsabilidades às redes.</p>
<p>Evitaria que por interpretações equivocadas ou até  monocráticas, bloqueios indevidos.</p>
<p>Até para preservar a democracia é preciso fazer isso. Temos que prevenir e deicxar claro as punições para quem produz fake news prejudiciais à população.</p>
<p>A liberdade de expressão não pode ser absoluta, se queremos conviver de uma maneira civilizada. </p>
<p>E quem alega que a pessoa deve entrar na justiça caso se sentir prejudicada, parece que vive numa realidade paralela. reverter um mal é muito dificil e ineficaz. Quantos exemplos temos de que uma fake news postada se torna uma verdade?</p>
